Jimmy johns/subway legal?

Why can jimmy johns and subway get away with both making sandwiches, legally i mean. Same for Micky d's and hardees/carl's jr etc they both make burgers and fries, so if i were to ever open a sandwich shop how would i be able to do it without 'ripping off' either and getting my @$$ sued
